GymPro — Terms & Conditions (Terms of Service)

These Terms & Conditions (“Terms”) govern your access to and use of gymproofficial.com (the “Site”) and any products and services offered through the Site (collectively, the “Services”) operated by GymPro LLC (“GymPro,” “we,” “us,” or “our”).

By accessing the Site or purchasing from us, you agree to these Terms. If you do not agree, do not use the Site.

1) Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order.

2) Privacy

3) Changes to the Site or Terms

We may update the Site, products, pricing, and these Terms at any time. Changes are effective when posted. Continued use means you accept the updated Terms.

4) Product Information & Availability

We aim to display product descriptions and images accurately, but colors and appearance may vary by device. Product availability can change without notice.

5) Orders, Acceptance, and Cancellations

  • Order Acceptance: Your order is an offer to buy. We may refuse or cancel any order for any reason, including suspected fraud, pricing errors, or inventory issues.

  • Pricing/Listing Errors: If an item is listed incorrectly, we may cancel your order and issue a refund for amounts paid.

  • Cancellations: Contact us immediately if you need to cancel. Once an order is processed/shipped, we may be unable to cancel it.

6) Pricing, Taxes, and Payment

Prices are shown in USD unless stated otherwise. You authorize us (and our payment processors) to charge your selected payment method for your order total, including shipping, taxes, and fees.

7) Shipping, Delivery, and Delays

Shipping options and estimated delivery windows are shown at checkout and/or in our Shipping Policy: [insert link].

If we can’t ship within the promised timeframe (or within 30 days if no timeframe is stated), we will provide notice and options consistent with applicable rules, including allowing you to cancel for a refund for any unshipped merchandise where required. (Federal Trade Commission)

8) Exchanges Only (No Refunds)

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS.
We offer exchanges only under the terms below (this does not limit any rights you may have that cannot be waived under applicable law).

Exchange Window

You may request an exchange within 14 days of delivery (based on carrier tracking).

Exchange Eligibility

To qualify, items must be:

  • Unworn, unwashed, and in resalable condition

  • Free from deodorant marks, stains, odors, pet hair, or damage

  • With original tags/packaging (if applicable)

Exchange Process

  • Start an exchange by contacting us at [support@gymproofficial.com] (replace if different) with your order number and requested exchange item/size.

  • Exchanges are subject to inventory availability.

Shipping Fees for Exchanges

  • Return shipping to us is paid by the customer.

  • We charge a $9.99 USD flat fee to ship the exchanged item back to you.

If Your Requested Exchange Isn’t Available

If the replacement item/size is unavailable, we may offer store credit or an alternative item (no refunds).

Non-Exchangeable Items (if applicable)

Unless we state otherwise, the following are not eligible for exchange:

  • Final sale/clearance items (if marked final sale)

  • Gift cards

  • Items noted as non-returnable on the product page

Important California Notice

9) Chargebacks & Fraud Prevention

Unauthorized chargebacks, false claims, or abusive return/exchange behavior may result in order refusal, account limitation, or other appropriate action.

10) User Content (Reviews, Comments, Photos)

If you submit content (reviews, comments, photos, etc.), you represent you have rights to it and you grant GymPro a worldwide, royalty-free license to use it for business purposes (including marketing). We may remove content at our discretion.

11) Intellectual Property

All Site content (logos, designs, text, images, product names, graphics) is owned by GymPro or its licensors and protected by law. You may not copy, distribute, or exploit Site content without written permission.

12) Prohibited Uses

You agree not to misuse the Site, attempt unauthorized access, transmit malware, scrape the Site without permission, or engage in fraudulent activity.

13) Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMPRO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. IN NO EVENT WILL GYMPRO’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO GYMPRO FOR THE ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15) Indemnification

You agree to indemnify and hold harmless GymPro and its affiliates from claims arising out of your misuse of the Site, violation of these Terms, or infringement of third-party rights.

16) Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree that disputes will be brought in state or federal courts located in Los Angeles County, California, and you consent to jurisdiction and venue there.

17) Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

18) Entire Agreement

These Terms, together with our Privacy Policy and any posted policies (Shipping, Exchanges, etc.), form the entire agreement between you and GymPro.
